Declaration of Data Protection

The protection of your personal data is of particular concern to us. As such, we will process your data exclusively on the basis of the statutory provisions (GDPR, 2003 German Telecommunications Act). In this data protection information, we will inform you if the most important aspects of data processing within the framework of our website. This also sets forth what kind of personal data is collected/secured when using our SecuReveal whistleblower system (the Whistleblower System).

Contact with us

Data transmitted via the contact form, including your contact data, will be stored in order to be able to process your request or to be available for follow-up inquiries. Such data will not be passed on without your consent.

The processing of the data entered in the contact form will take place exclusively on the basis of your consent (Art. 6 (a)(a) GDPR). You may revoke a consent that you have already given at any time. For such revocation, informal notification by e-mail is sufficient. Such revocation will not affect the lawfulness of the data processing operations carried out until the revocation.

We will retain data transmitted via the contact form until you request erasure, revoke your consent to storage, or the point at which there is no longer any need for data storage. This does not affect mandatory statutory provisions – in particular retention periods.

We process personal data in accordance with and pursuant to the EU General Data Protection Regulation (the GDPR) as well as the applicable national data protection laws. Unless otherwise defined in this policy, the terms used herein have the same meanings as given to them in the GDPR. Additionally, Article 6 (1) (c) GDPR serves as legal basis for processing of data under the Whistleblower System is – fulfillment of a legal obligation, namely the provision of an internal whistleblower system in accordance with Section 8 in conjunction with Section 11 of the Whistleblower Protection Act (HSchG).

Notices via the Whistle Blower System

When using/visiting the whistleblower system via our website, your browser automatically transmits your IP address and other information about the system you are using (such as the browser used and the browser version). The processing of this data is necessary in order to make our website available to you correctly on your respective device. The firewall of our processor checks this connection data using automatically created log files in order to be in the position to detect and prevent hostile/harmfull attacks on our system. Legal basis: Art 6 Para 1 lit f GDPR – legitimate interest in maintaining the functionality, stability and security of our website.

The Whistleblower System is designed to guarantee whistleblowers the highest possible level and standard of data protection. The whistleblower system can be used anonymously without providing personal data, so that the anonymity of the whistleblower can be fully preserved when submitting a report.

 

The Whistleblower System provides for special encryption methods ensuring that only the respective whistleblower and our responsible compliance officers have access to the report(s) provided. Within our company, the data contained in the report will, hence, only be passed on to the relevant compliance officer, passing on to third parties (with the exception of any passing on to the competent authorities or courts and auditors for further tracking of the facts on which the report is based) does not take place. In particular, there is no possibility of access to data contained in the report by our processors.

Depending on the data you make available to us, we process the following personal data:

(i)          Identification data of the whistleblower and the accused (e.g. name, personnel number)

(ii)         (private) contact information of the whistleblower (e.g. address, e-mail address, telephone number)

(iii)       Position within the company

(iv)        Details of the facts and issue(s)

(v)         Communication with the compliance officer

(vi)       Details of follow-up actions (e.g. investigations)

(vii)      Technical secondary data (IP address of access to the Whistleblower System)

It is also possible to submit reports via our Whistleblower System without providing any information/data on your identity. In such case you remain anonymous.

 

Purposes of data processing

We will process your personal data for the following purposes:

  • to make this website available to you and to further enhance and develop this website
  • to create usage statistics
  • to detect, prevent, and investigate attacks on our website
  • to respond to your requests
  • in line with the Whistleblower System

 

Transmission of your personal data

For the purposes mentioned above, we will transfer your personal data to the following recipients:

  • IT service providers or contract processors used by us
  • for the technical hosting of the Whistleblower System: RBS Responsible Business Solutions GmbH with its seat in Vienna (no content-related data of the report is transmitted, only technical secondary data) as well as the technical sub-processors A1 Telekom Austria AG and Wolf Rechtsanwälte GmbH & Co KG; and
  • in case and to the extent disclosure is required (i) by law or regulation; or (ii) to establish, exercise or defend legal claims, we may also disclose personal data to competent authorities, such as supervisory, regulatory or criminal authorities, courts or to third parties who advise us in this context (e.g. lawyers, forensic experts or auditors).

 

Your rights

  • Right to access, rectification or erasure
    Within the framework of the applicable statutory provisions, you have the right at any time, pursuant to Art. 15 GDPR, to free access regarding your stored personal data, the origin of the data, its recipients and the purpose of the data processing, and a right to rectification or erasure pursuant to Arts. 16 and 17 GDPR of such data. In this regard and also for further questions on the subject of personal data, you can contact us at any time via the contact options listed in the Legal Notice.
  • Right to data portability
    Pursuant to Art. 20 GDPR, you have the right to have data that we process automatically on the basis of your consent or in the fulfillment of a contract handed over to you or to third parties. The data will be provided in a machine-readable format. If you request the direct transfer of the data to another controller, we will only do this only to the extent that it is technically feasible.
  • Right to object
    If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1)(1)(f) GDPR, you have the right, pursuant to Art. 21 GDPR, to object to the processing of your personal data if there are reasons for this that arise from your particular situation or if the objection is directed against direct advertising. In the latter case, you have a general right of objection, which we will act on, without the need to state a particular situation. If you would like to make use of your right of revocation or objection, sending us an e-mail message would be sufficient.
  • Revocation of your consent to data processing
    Some data processing operations are only possible with your express consent. Pursuant to Art. 7 (3) GDPR, you may revoke a consent that you have already given at any time. For such revocation, informal notification by e-mail is sufficient. Such revocation will not affect the lawfulness of the data processing carried out until the revocation.
